COOKIES POLICY
Article 4 of R.D-Law 13/2012 transposes Directive 2009/136/EC of the European Parliament and of the Council into Spanish law, amending Article 22.2 of the LSSI (Law 34/2002), thus configuring the current regulations of the so-called “Cookies Law or Anti-Cookies Law”. As a result, the owners of websites that install cookies (including third-party cookies such as Google Analytics cookies) must provide adequate information and ensure that their users consent to the installation of cookies.
It makes no difference whether the website is hosted by a European hosting provider, Facebook, etc. In any case, if your entity is Spanish or provides services specifically aimed at the territory of the Spanish State, you must comply with the Law.
The Cookies Law is different from the Data Protection Law. They are to be applied as follows:
- Cookie that is not used to process personal data: Only the Cookie Law must be complied with.
- Cookie that is used to process personal data: The Data Protection Law and, in addition, the Cookie Law must be complied with.

Levels of intrusiveness
The above cookies can be classified according to the criterion of “level of intrusiveness”, on a scale of 1 to 3:
- Level 1: corresponds to internal use cookies essential for the provision of the service requested by the user.
- Level 2: corresponds to anonymous cookies for internal use necessary for the maintenance of content and navigation, as well as cookies managed by third parties within the framework of services expressly requested by the user on their websites (e.g.: Social Plugins from Facebook or Twitter).
